General Terms and Conditions
This is a courtesy English translation; the German version is legally binding.
§ 1 Scope & provider
These terms and conditions apply to all orders placed via the Professor Digital online shop (Alexander Holtermann, Darmstädter Str. 24a, 64521 Groß-Gerau). The contract language is German. A consumer is any natural person who concludes a legal transaction for predominantly private purposes.
§ 2 Conclusion of contract
The presentation of products in the shop does not constitute a binding offer. By clicking the order button you submit a binding offer to purchase. The contract is concluded upon our confirmation or the provision of the product.
§ 3 Prices & payment
All prices include statutory VAT. Payment and invoicing including stated VAT are handled via the payment service provider Stripe.
§ 4 Delivery & provision
Print products are shipped to the delivery address provided. Digital books are provided exclusively as online reading access via our reader; no file download takes place. Access is activated after receipt of payment.
§ 5 Right of withdrawal for consumers
Withdrawal instructions. You have the right to withdraw from this contract within fourteen days without giving any reason. The period is fourteen days from receipt of the goods (for print products). To exercise this right you must inform us (Professor Digital, Darmstädter Str. 24a, 64521 Groß-Gerau, email: widerruf@professor-digital.de) by means of a clear statement. To meet the deadline it is sufficient to send your notification before the period expires.
Consequences. In the event of an effective withdrawal, we will refund all payments received including delivery costs without undue delay, at the latest within fourteen days. You bear the direct costs of returning the goods.
Expiry for digital content. For digital content not supplied on a tangible medium (online reading access), the right of withdrawal expires once we have begun performance after you have expressly consented and confirmed your knowledge that you lose your right of withdrawal (Sec. 356(5) BGB).
§ 6 Warranty & liability
The statutory rights regarding defects apply. We are liable without limitation for intent and gross negligence as well as for injury to life, body or health; for simple negligence only in the event of a breach of material contractual obligations, limited to the foreseeable damage.
§ 7 Dispute resolution & final provisions
Online dispute resolution platform: https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board. German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions remain unaffected.
